HCS Connect EVV mobile application

Applies to: HCS Connect EVV mobile application (com.hcstrategies.hcs.evv) for Android and iOS.

1. Who we are

HCS Connect EVV is provided by HealthCare Strategies, Inc. (“we”, “us”), 5746 Marlin Rd., Suite 600, Chattanooga, TN 37411.

The app is used by clinicians and caregivers employed by or contracted to home health and home care agencies (“Agencies”) that license our software. It is not available to the general public.

Where the app processes protected health information, we act as a Business Associate of the Agency under the Health Insurance Portability and Accountability Act (HIPAA). The Agency is the covered entity and controls that information. Our handling of it is governed by our Business Associate Agreement with that Agency, which takes precedence over this policy where the two differ.

2. Why the app collects what it does

Electronic Visit Verification is required by federal law — section 12006 of the 21st Century Cures Act — for Medicaid-funded personal care and home health services. Federal and state rules require that each visit record capture the type of service, the individual receiving it, the individual providing it, the date, the location, and the start and end times.

The app exists to capture that record and transmit it to the Agency and, where required, to the state’s designated EVV aggregator. We do not use any of it for advertising, profiling, or resale.

3. Information the app collects

Account and identity

  • Your name, username, and internal employee identifier

  • Authentication tokens issued when you sign in

Visit records

  • Patient name and identifier, visit date, service category, and discipline

  • Comments you enter, and any manual-entry reason codes you select

  • The date and time you start and stop a visit, taken from your device’s clock at the moment you tap Start or Stop

Location

  • Your device’s geographic coordinates — latitude, longitude, altitude, and accuracy — captured at the moment you start or stop a visit, and at no other time

  • The app does not track your location in the background, does not follow your movements between visits, and does not collect location while it is closed

Device information

  • A device identifier used to associate visit records with the device that created them

  • Network connectivity status, used to decide whether to submit immediately or store for later

Schedule information shown to you

  • Patient names, addresses, and phone numbers for the visits assigned to you

Diagnostic logs

  • Application error and event logs, which may include your username, device identifier, and the action being performed when a problem occurred

4. Device permissions

You may decline or revoke any of these in your device settings. Declining location will prevent the app from recording a verified visit, because a location is part of the record the law requires.

5. How information is stored

Visit records you create are stored on your device in an application database so the app keeps working without a network connection. They are submitted to our servers when connectivity returns and remain on the device until they have been successfully submitted.

Because visit records may be held on the device, you should protect your device with a passcode or biometric lock and report a lost or stolen device to your Agency immediately.

6. Who information is shared with

  • Your Agency — the employer or contracting organization whose patients you serve. The Agency is the owner of the visit and patient information.

  • State EVV aggregators and Medicaid programs — where state law requires visit records to be submitted to a designated aggregator, we transmit them on the Agency’s behalf.

  • Service providers — vendors who host or support our systems, bound by contract to protect the information and use it only to provide those services.

  • When legally required — in response to lawful requests, subpoenas, audits, or to protect safety and legal rights.

We do not sell personal information. We do not share it with advertisers or data brokers. The app contains no advertising, analytics, or tracking software.

7. Security

We use industry-standard measures to protect this information, including encrypted transmission between the app and our servers, authenticated access, and access controls limiting who may view visit and patient records.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. How long information is kept

Visit records are retained for as long as required by the Agency’s agreement with us and by applicable Medicaid, state EVV, and healthcare recordkeeping requirements. Records held locally on your device are removed once successfully submitted.

9. Your choices and rights

If you are a clinician using the app: you may request access to or correction of your own account information by contacting us at Support@hcstrategies.com or through your Agency. Note that visit records are business and healthcare records; they cannot generally be deleted on request, because they are required to be retained.

If you are a patient: we process your information on behalf of your care Agency. Requests to access, amend, or restrict your health information should be directed to that Agency, which is responsible for responding under HIPAA and applicable state law. We will support the Agency in responding to those requests.

Depending on where you live, you may have additional rights under state privacy law. Contact us at Support@hcstrategies.com and we will respond as those laws require.

10. Children

The app is a workforce tool and is not directed to children. We do not knowingly collect information from children through the app. Where a patient receiving care is a minor, their information is handled as protected health information under the Agency’s direction.

11. Changes to this policy

We may update this policy. Material changes will be reflected by a new effective date at the top of this page, and the current version will always be available at https://www.hcstrategies.com/connect-evv-privacy-policy.
